The Family Medical Leave Act (FMLA) is a federal law that entitles eligible employees to unpaid, job-protected leave for specific family and medical reasons. Employers covered by the FMLA must also preserve employees’ job roles and continue group health benefits during the leave.
Employee Eligibility
To qualify for FMLA leave, an employee must:
- Work for a covered employer, such as public agencies, schools, or private-sector employers with 50 or more employees.
- Have been employed for at least 12 months.
- Have completed at least 1,250 hours of work during the prior 12 months.
Reasons for FMLA Leave
Eligible employees may take leave for:
- The birth or care of a newborn child.
- Placement of a child for adoption or foster care.
- Caring for a spouse, child, or parent with a serious health condition.
- Their own serious health condition that affects job performance.
- Certain exigencies related to a family member’s military duty.
Common Employer Violations
- Denying eligible employees their right to take FMLA leave.
- Retaliating against employees for requesting or taking leave.
- Failing to reinstate employees to their original or equivalent positions after leave.
