Sexual Harassment

Sexual harassment is unlawful behavior that creates a hostile work environment or involves unwelcome advances, requests for favors, or other verbal or physical conduct of a sexual nature. Both California and federal laws provide robust protections to ensure workplaces remain safe and respectful for all employees.

Types of Sexual Harassment

Sexual harassment can take several forms, including:

  • Quid Pro Quo: When employment decisions, such as promotions or continued employment, are contingent on providing sexual favors.
  • Hostile Work Environment: When offensive comments, gestures, or behaviors create an intimidating, hostile, or offensive workplace.
  • Retaliation: Punishing an employee for reporting or resisting harassment.

Legal Protections Against Sexual Harassment

California and federal laws provide strong safeguards, including:

  • California Fair Employment and Housing Act (FEHA): Prohibits sexual harassment in workplaces of any size and requires employers to take proactive steps to prevent and address harassment.
  • Title VII of the Civil Rights Act: Protects employees in workplaces with 15 or more employees from sexual harassment.
  • California Labor Code: Mandates that employers establish effective anti-harassment policies and investigate complaints promptly.

Steps to Take If You Experience Sexual Harassment

1. Document the Harassment: Keep detailed records of incidents, including dates, times, locations, and any witnesses.

2. Report the Behavior: Notify your employer or HR department about the harassment.

3. File a Complaint: You may file a complaint with the California Civil Rights Department (CRD) or the Equal Employment Opportunity Commission (EEOC).

4. Consult an Attorney: An experienced lawyer can help you understand your rights and pursue justice.
