Employment Discrimination

At Atticus Law Group, we believe every employee deserves a workplace free from discrimination. Unfortunately, many individuals experience unfair treatment based on their identity or personal characteristics. Employment discrimination occurs when an employer unlawfully treats an employee or job applicant unfavorably due to factors such as race, gender, sexual orientation, age, disability, or other protected traits under California and federal laws.

Types of Employment Discrimination

Discrimination can take many forms, including:

  • Hiring and Firing: Refusing to hire or terminating someone based on a protected characteristic.
  • Pay and Benefits: Providing unequal pay, bonuses, or benefits due to discriminatory motives.
  • Workplace Policies: Implementing policies that disproportionately harm a specific group, even if they appear neutral.
  • Harassment: Fostering a hostile work environment with inappropriate comments, jokes, or actions targeting protected traits.
  • Promotion and Job Assignments: Denying promotions, raises, or desirable assignments based on bias.

Legal Protections Against Discrimination

California provides some of the strongest anti-discrimination protections in the nation:

  • California Fair Employment and Housing Act (FEHA): Prohibits discrimination and harassment in workplaces with five or more employees.
  • Title VII of the Civil Rights Act of 1964: A federal law banning discrimination based on race, color, religion, sex, and national origin.
  • Age Discrimination in Employment Act (ADEA): Protects workers aged 40 and older.
  • Americans with Disabilities Act (ADA): Requires reasonable accommodations for individuals with disabilities and bans discriminatory practices.

Steps to Take If You Experience Discrimination

If you believe you’ve been discriminated against, you should:

1. Document the Incidents: Keep detailed records of discriminatory actions, including dates, times, and witnesses.

2. Report the Issue: Notify your employer or HR department about the discrimination.

3. File a Complaint: Submit a complaint to the California Civil Rights Department (CRD) or the Equal Employment Opportunity Commission (EEOC).

4. Consult an Attorney: An experienced employment lawyer can help you navigate the process and protect your rights.
